Articolo 52 - CODICE DELLA STRADA

I ciclomotori a tre ruote possono, per costruzione, essere destinati al trasporto di merci. La massa e le dimensioni sono stabilite in adempimento delle direttive comunitarie a riguardo, con decreto del Ministro dei trasporti, o, in alternativa, in applicazione delle corrispondenti prescrizioni tecniche contenute nelle raccomandazioni o nei regolamenti emanati dall'ufficio europeo per le Nazioni Unite - Commissione economica per l'Europa, recepiti dal Ministero dei trasporti, ove a cio' non osti il diritto comunitario.
Le caratteristiche dei veicoli di cui ai commi 1 e 2 devono risultare per costruzione. Nel regolamento sono stabiliti i criteri per la determinazione delle caratteristiche suindicate e le modalita' per il controllo delle medesime, nonche' le prescrizioni tecniche atte ad evitare l'agevole manomissione degli organi di propulsione.
Detti veicoli, qualora superino il limite stabilito per una delle caratteristiche indicate nei commi 1 e 2, sono considerati motoveicoli. (4)
